Common Law Marriages, Same-Sex Marriage & Domestic Partnerships

Marriage equality has made the practice of family law even more sprawling, to include representation for persons engaged in common law and same-sex marriages and divorces, domestic partnerships and other forms of cohabitation.

Is your nontraditional relationship ending in New York? I can help ? just as I've helped a multitude of individuals and families over the past 40-plus years.

I am family law attorney Robert G. Smith, founder of the Robert G. Smith, PLLC, law firm ? serving clients in all five boroughs and surrounding counties such as Suffolk, Nassau and Westchester.

Here are some observations you might find useful:

Common Law Marriage

Generally, common law marriage refers to two people living as husband and wife, and holding themselves out as husband and wife, but lacking a marriage license or legally recognized ceremony. The state of New York does not recognize common law marriage, but New York courts will recognize the common law marriage entered into in another state.

Same-Sex Marriage

In June 2015, the United States Supreme Court decision in Obergefell v. Hodges held that no state can ban same-sex marriage.

LGBT and domestic partnership clients require the same attention and expertise as traditional matrimonial and divorce law cases. I represent members of the LGBT community regarding agreements and the financial dissolution and child custody issues arising in and from domestic unions, marriage, cohabitation, and partnership and separation agreements.

Domestic Partnerships

New York City permits the registration of domestic partnerships. If you reside in New York City, for a nominal fee you can register as domestic partners.

I can advise members of all of these groups on topics like tax considerations, cohabitation agreements and separation agreements. I pledge to provide you with the experienced, skilled legal assistance and counsel you need and deserve.
