Enforcing Your Rights

If you are the non-moneyed spouse involved in a divorce, the State of New York provides you important rights that will help you survive financially.  I will help you enforce these rights.

You have a right to obtain an early and quick injunction restraining the disposition of marital assets by your spouse.

You may have been living very well until there were marital problems. Then all of the sudden your spouse tells you the business that was worth $20 million dollars last month is now worth 20 cents. To prevent assets from disappearing, you need an injunction right away that restrains any transactions by your spouse except in the ordinary course of business. As your attorney, I will make a prompt court application for that injunction.

Temporary Child Support

If you have children, you have a right to obtain temporary child support. This relief will allow you to maintain the status quo in the marital residence during the pendency of your divorce action. As your attorney, I will help you obtain appropriate support for your children while the issues of permanent child custody, visitation and support are resolved. Forensic Accounting

You have a right to preserve marital assets. When appropriate we will engage a forensic accountant to identify and appraise the marital property.  If property is missing, the accountant can help us to chart the paprer trail, to recover the assets and to prevent any further manipulation of the marital estate.

Spousal Maintenance

One of the most important steps that a non-moneyed spouse can take is to seek a generous spousal support order, to level the playing field, to help maintain the marital standard of living and to enable you to have your day in court. In the course of a year until your case is ready for trial, you could get starved out unless a good and diligent lawyer can go to court and obtain a spousal support award for you.  The paying spouse needs to make sure that too much money is not ordered to be paid temporarily, otherwise there will never be an inducement to finish the case.  I will also negotiate for permanent spousal maintenance during the divorce process.
